How KinClear handles information.
Built around clarity and security. We use the minimum information reasonably needed to provide and administer the service and we do not ask for passwords.
What information we use
For a live case this may include the living customer's or professional contact's name, contact details, relationship to the estate, instructions, authority evidence, correspondence and case administration records. The service may also process information about the deceased and account identifiers supplied for estate administration. Information solely about a deceased person is not personal data under UK GDPR, although we still handle it carefully.
Why we use information
We use customer and case-administration information where necessary to take requested pre-contract steps and perform the KinClear contract. We may also process limited records where necessary to comply with legal obligations, and use proportionate legitimate interests for service security, fraud prevention, case administration and resolving complaints where those interests are not overridden by an individual's rights.
Discovery sources
Discovery may use information supplied by the person handling the estate and lawful publicly accessible sources. Where personal information about a living person is obtained from another source, the source/category and applicable privacy information will be handled as required.
Who information may be shared with
Only where needed for the service: infrastructure and communications processors acting for KinClear, Stripe for payment processing, and the relevant account/provider organisation when an authorised request is made. We keep a production processor record and review international-transfer safeguards where relevant.
Retention
- Uncompleted enquiries/intakes: normally up to 90 days.
- Completed case administration, contract and payment records: normally 6 years where needed for legal/accounting/contract records.
- Authority evidence and provider correspondence: retained with the case only as long as reasonably needed for the service, disputes or legal obligations, then deleted or minimised.
- Discovery working material that is not needed in the final case record: removed as soon as reasonably practicable after review/completion.
Your rights
Living individuals may have rights including access, correction, erasure, restriction, portability and objection depending on the processing and lawful basis. Requests can be made using the customer contact route above. You may also complain to the Information Commissioner's Office.
Security
We do not ask for deceased-account passwords, authentication codes, PINs, card-security data, private keys or recovery phrases. Consequential provider actions are blocked until appropriate authority and a clear customer decision are recorded.
